Terms and Conditions

These Terms and Conditions ("Terms") govern the services provided by Blue Horizons Innovation ("we," "us," or "our") to the client ("you" or "your"). By subscribing to our packages, you agree to these Terms.

1. Scope of Services

We provide website design, development, and related digital marketing services as detailed in the subscribed package. Each package includes specific deliverables as outlined on our website and service catalog.

2. Ownership and Usage

• We retain ownership of the website, hosting, and DNS (e.g., yourwebsitehere.com) for one year from the subscription start date.
• All design and content assets generated during the subscription will belong to you.
• You have full rights to use the work commercially during the subscription term.

3. Timeline and Delivery

• Websites will be operational within the first week of the subscription and connected to a DNS upon your approval.
• Search engine rankings are limited to local rankings. Expected timelines are as follows:
  • Within the first month: Placement within the first 10 pages.
  • Within the second month: Placement on the first page (for applicable packages).
  • Further improvements will depend on the selected package and the third month’s progress.
• If you delay providing necessary feedback or materials, other deliverables will proceed as scheduled, but dependent tasks may be delayed.

4. Liabilities

• We will make every effort to market your products or services effectively. However, we are not responsible for outcomes influenced by factors outside our control (e.g., product quality, customer reviews).
• We take responsibility for errors or delays caused by us. In such cases, we will compensate by extending your subscription by one month, rather than monetary reimbursement.

5. Confidentiality

We handle sensitive information, including account credentials (e.g., Google Business, Google Search Console, payment methods), with strict confidentiality. Such information will only be used for the purpose of delivering the agreed-upon services.

6. Termination

• If you terminate the subscription, our services will remain available until the end of the subscription term, unless you request otherwise.
• If we terminate the agreement, we will refund the remaining subscription balance within two months of termination.

7. Additional Work

Any work outside the agreed subscription scope will be billed hourly based on the subscribed package tier.

8. Payment Terms

Payments can be made via GCash, Stripe, or bank transfer. Specific details will be provided upon subscription.

9. Governing Law

These Terms are governed by the laws of Cebu City, Philippines.

10. Acknowledgment of Terms

By subscribing to our packages, you acknowledge and agree to these Terms.

11. Progress Reports

• Progress reports will be provided monthly.
• For Premium Tiers (Ultimate and Powerhouse packages), weekly updates are available upon request.

12. Other Clauses

• Force Majeure: We are not liable for delays or failures resulting from events beyond our control (e.g., natural disasters, internet outages).
• Dispute Resolution: Any disputes will first be resolved through mediation. If unresolved, disputes will be escalated to the appropriate legal authority in Cebu City, Philippines.
